Welcome to Ark. These Terms of Use (“Terms”) govern your use of the Ark wellbeing matching app (“Ark”, “we”, “us”). By creating an account or using Ark, you agree to these Terms. Please read them carefully.
1. Eligibility
You must be 18 years or older to use Ark.
You confirm that the information you provide is accurate and up to date.
2. Our Service
Ark connects you with independent wellbeing practitioners.
Recommendations are based on the information you provide and may involve profiling. These recommendations are advisory only.
Ark does not provide medical or therapeutic advice. Always consult a qualified healthcare provider for medical concerns.
3. Your Responsibilities
You are responsible for the accuracy of the information you provide.
You agree not to misuse Ark (e.g. unlawful use, harassment, misrepresentation).
You must keep your login details confidential.
4. Payments & Subscriptions
Certain features require payment or a subscription.
Payment terms will be displayed before you purchase.
Payments are securely processed by third-party providers.
Refunds are subject to our Refund Policy [insert link].
5. Data & Privacy
Your data is processed in line with our [Privacy Policy].
Until you pass the payment wall, sensitive wellbeing data you provide is not linked to your personal identity.
Once subscribed, your personal details (name, email, payment) will be linked to your wellbeing profile.
6. Limitation of Liability
6.1 Platform Role
Ark’s role is limited to matching and connecting you with practitioners. All communication, booking, payments for services, and delivery of those services take place directly between you and the practitioner.
6.2 Practitioner Responsibility
Practitioners are independent professionals, not employees or agents of Ark.
They are solely responsible for the advice, treatments, and services they provide.
Ark does not supervise or control practitioner services.
6.3 No Liability for Practitioner Services
Ark is not responsible for:
the quality, safety, or suitability of practitioner services;
any advice, treatment, or outcomes from practitioner services;
disputes, cancellations, refunds, or complaints between you and practitioners;
personal injury, financial loss, or damages arising from practitioner services.
6.4 Maximum Liability
Ark’s total liability to you is limited to the amount of subscription fees you paid in the 12 months before the claim.
We exclude liability for indirect or consequential losses (e.g. profit loss, business interruption, emotional distress).
7. Termination
We may suspend or terminate your account if you breach these Terms.
You may delete your account at any time.
8. Governing Law
These Terms are governed by the laws of England and Wales.

These Terms of Use (“Terms”) govern your participation as a practitioner (“you”) on the Ark wellbeing app (“Ark”, “we”, “us”). By registering, you agree to these Terms.
1. Eligibility & Verification
You must be 18 years or older to join Ark as a practitioner.
You must provide accurate information, including proof of qualifications, insurance, and any required licences.
Ark may verify credentials and remove your profile if verification fails.
2. Your Responsibilities
You are responsible for the accuracy of your profile.
You must keep client information confidential and only use it for responding to enquiries or delivering services.
You must comply with professional, ethical, and legal standards relevant to your practice.
3. Data & Privacy
Practitioner profiles contain personal and professional information (e.g. qualifications, specialisms), which will be displayed publicly.
You must comply with data protection laws when handling client data.
You are an independent data controller for any records you create or store in the course of service delivery.
4. Payments
Payment terms for subscriptions or leads will be displayed in your account.
You are responsible for your own taxes related to income earned through Ark.
5. Independence of Services
You remain an independent professional. Ark does not supervise, direct, or control your services.
You are solely responsible for the quality, safety, and outcomes of services you provide.
6. Limitation of Liability & Indemnity
6.1 Platform Role
Ark’s role is limited to facilitating matches and introductions. All communication, booking, payment arrangements, and service delivery remain solely between you and the client.
6.2 Independent Responsibility
You acknowledge you are not an employee, partner, or agent of Ark.
You are solely responsible for the services you provide and compliance with all applicable standards.
6.3 No Liability for Practitioner Services
Ark is not liable for:
acts, omissions, or errors on your part;
the quality or outcomes of your services;
disputes, cancellations, or complaints between you and clients;
personal injury, financial loss, or damages linked to your services.
6.4 Indemnity
You agree to fully indemnify Ark, its directors, employees, and agents against any claims, demands, liabilities, or costs (including legal fees) arising from:
your services, advice, or treatments;
your breach of these Terms;
any misrepresentation in your profile or credentials;
any breach of confidentiality, professional, or data protection obligations.
6.5 Maximum Liability of Ark
Ark’s total liability to you is limited to the subscription or service fees you paid in the 12 months before the claim.
Ark excludes liability for indirect or consequential losses (e.g. lost income, business interruption, reputational damage).
7. Termination
Ark may suspend or terminate your account if you breach these Terms or fail to maintain required credentials.
You may close your account at any time.
8. Governing Law
These Terms are governed by the laws of England and Wales.
